THE TRUST
The trust is an obligation (of an entrusting nature) that arises following the entrusting of a good or of a right to a subject (the trustee) because he treats or uses it, as the owner, according to the terms and conditions established in the institution act, in the interest of a third parties (the beneficiaries) or to achieve a target.
The goods or rights in trust:
- belong to the trustee, who has the full ownership but they must not be confused with his property (so they are segregated)
- they are not attackable by particular creditors of the trustee neither to certain conditions by creditors of the beneficiaries
- they are not attackable by particular creditors of the subject who has carried out the transfer in trust (settlor), because he is not the owner anymore
- they are not included in the hereditary succession, mortis causa, of the settlor or of the trustee.
